摘要:: 媒体的报道，有利于案件审理的公正、公平和公开，也有利于刑事被害人国家援助的获取以及相关制度的建构与完善；然而，过度的媒体报道也会对被害人的生命权、隐私权、名誉权、财产权和生活安宁造成二次伤害；某些媒体的选择性报道和过多细节的披露更是对被害人权利的保障造成严重的阻滞影响。因此，面对新闻自由与刑事被害人权利保障的冲突，我们需要建构知情同意制、事先审查制、事后补偿制、公众知情权平衡机制等规范与平衡制度。

Abstract:: News reports would play a positive role in making sure that a case trial would be fairly, justly and publicly heard, as well as helping the victims to obtain the national assistance and contributing to the perfection of the related system for our country. However, excessive news reports would cause secondary damage to the rights of life, privacy, reputation, property, and peaceful life of the criminal victims. Selective reports of some news media and the disclosure of too much detail could badly impede the protection of the victims’ rights. Based on the conflict between the freedom of the press and the protection of the rights of criminal victims, we need to construct such balanced and normative systems as informed consent system, prior review system, compensation system, and balance mechanism for public rights.
