摘要:: 认定抗拒疫情防控措施相关犯罪，以危险方法危害公共安全罪能否适用、何种情形下适用以及如何适用，是刑事法学界和司法实践中的难题。适用以危险方法危害公共安全罪符合犯罪故意理论的基本涵义，是罪刑相适应原则的要求，体现了过失犯罪故意化的趋势，也是风险防控和法益保护的需要。以危险方法危害公共安全罪犯罪主观方面的认定，适用相对严格责任和推定过错。

Abstract:: Whether,under what circumstances and how to apply the crime of endangering public security by dangerousmeans is a difficult problem in the academic and judicial practice when identifying the crime of resisting epidemic prevention and control measures.The application of this crime is the need of risk prevention and legal interest protection,and also the requirement of the principle of crime and punishment adapting to each other,reflecting the trend of intentional negligent crime.In the subjective aspect of this crime,the relatively strict liability and presumptive fault should be applied.
