摘要:: 对于网络平台运营者而言，只要用户利用网络平台实施了故意犯罪，就可能产生帮助犯的刑事可罚性。尽管理论和实践普遍认为网络平台运营者能够成立用户犯罪的帮助犯，但是，其中具体的成立条件仍然有待澄清。运营网络平台的行为成立用户所实施之主行为的帮助犯，需要满足2个条件：平台运营者对网络平台的运营必须对用户借助平台所实施之主行为具有客观上可归责的帮助作用；平台运营者必须具备相应的帮助故意。因此，有必要分别从这2个方面对网络平台运营者之帮助犯的成立条件进行澄清。

Abstract:: Internet platform operators may incur criminal liability for facilitating user-committed intentional crimes as soon as such crimes are executed via their platforms. Although it is widely accepted in theory and practice that Internet platform operators can be held liable as accomplices to user crimes, the specific conditions for such liability still need clarification. Internet platform operator’s liability as an accessory to a user’s principal act requires satisfying two conditions: the operator’s management of the platform must objectively aid the user’s principal act, and the operator must have the corresponding intent to assist. Therefore, it is necessary to clarify the conditions for the liability of Internet platform operators as accomplices from these two aspects.
