摘要:: 体育健康权是指社会成员人人享有的基本公共体育服务权利。对于该权利的落实，需要国家直接提供公共体育服务去满足和实现。实践中出于种种原因，城市弱势群体体育健康权的保障有很多不足。对此，立法机关因立法程序繁琐、现行立法过于宽泛而发挥作用较小；行政机关是保障城市弱势群体的主要机关，但其治理能力不足，且缺乏监督；司法机关因相关法律的粗疏、民众权利意识淡薄且缺乏动力提起诉讼等原因影响力较弱。检察机关相比其他国家机关具有独特优势，可以通过提起刑事、民事、行政公益诉讼，提出检察建议等方式来保障公民的体育健康权。

Abstract:: The right of sports health refers to the right of every member of society to enjoy basic public sports services.For the implementation of this right,it is necessary for the state to provide public sports services directly to meet and realize it.In practice,due to various reasons,there are many deficiencies in the protection of sports health rights of urban vulnerable groups has many deficiencies.In this regard,the legislature due to complicated legislative procedures,the existing legislation is too broad to be effective; administrative organ is the main organ to protect urban vulnerable groups,but its governance capacity is insufficient and lacks supervision; the judicial organs have weak influence due to the carelessness of relevant laws,the weak awareness of public rights and the lack of motivation to file lawsuits.Compared with other state organs,procuratorial organs have unique advantages.They can protect citizens’ right to sports health by filing civil and administrative public interest litigation,criminal litigation and procuratorial suggestions.
