摘要:: 针对青少年体育健康权益保障不足与学校体育治理体系失衡问题，基于法律家长主义理论框架，运用文献分析与国际比较方法，系统剖析了《学校体育工作条例》在保障青少年体育权益方面存在的制度性缺陷。研究表明，现行《学校体育工作条例》存在课程标准缺失、责任配置失衡、资源配置断层及风险防控缺位等问题。研究提出，明确修订方向是前提，优化生师权益是重点，建立多方责任共担是抓手，强化监督与评估是关键。研究结论认为，修订后的制度框架将更全面保障青少年健康权益，提升学校体育治理能力，为落实“健康中国2030”战略提供可行的制度范式，最终实现国家干预与个体发展权的有效平衡。

Abstract:: To address the inadequacy in safeguarding adolescents’ sports health rights and the imbalance in school sports governance systems,this study systematically examines the institutional defects of the Regulations on School Physical Education Work in protecting youth sports rights through literature analysis and international comparisons under the legal paternalism theoretical framework.The findings reveal critical deficiencies in the current regulations:absence of standardized curriculum requirements,imbalanced responsibility allocation,fragmented resource distribution,and insufficient risk prevention mechanisms.The research proposes a four-dimensional revision framework:1) clarifying revision directions as the prerequisite,2) optimizing student-teacher rights as the priority,3) establishing multi-stakeholder responsibilitysharing mechanisms as the operational focus,and 4) strengthening supervision and evaluation as the implementation cornerstone.The study concludes that the revised institutional framework will comprehensively enhance the protection of adolescents’ health rights,elevate school sports governance efficacy,provide an actionable institutional model for advancing the "Healthy China 2030" strategy,and achieve effective equilibrium between state intervention and individual developmental autonomy.
