摘要:
完善期限规则是保障中国体育仲裁委员会（CCAS）高效履行仲裁职责的关键举措，也是提升我国体育仲裁公信力的核心程序支撑。当前《体育仲裁规则》虽已初步构建期限制度框架，但仍存在三大缺陷：21天期限法律性质不清、仲裁申请期限起算点不明、不同程序类型期限规则未区分等。针对CCAS在期限规则方面所面临的制度困境与实践难题，可借鉴国际体育仲裁院（CAS）成熟的期限制度经验，通过厘定21天期限的上诉期限性质、明确仲裁申请期限的起算、完善其他期限制度内容等方面入手，以此强化规则的明确性与可操作性的平衡，为我国体育纠纷解决机制的本土化提供理论与实践参考。
Abstract:
Improving the rules on deadlines is a key measure to ensure that the China Commission of Arbitration for Sports (CCAS) performs its duties efficiently in the process of dispute resolution,and it is also the core procedural support to enhance the credibility of sports arbitration in China.Although the current Sports Arbitration Rules initially established a framework for time limits,there were still three major shortcomings:the nature of the 21-day time limit was unclear,the starting point for the arbitration application time limit was unclear,and the time limits for different types of procedures were not clearly distinguished.In view of the systemic and practical difficulties of CCAS in terms of the duration rules,drawing on the mature experience of the Court of Arbitration for Sport (CAS) in terms of the duration system,CCAS can provide theoretical and practical guidance for the localization of China’s sports dispute resolution mechanism by clarifying the nature of the appeal period of the 21-days deadline,clarifying the starting point of the deadline for arbitration application,and perfecting the content of the other duration systems through the balanced design of enhancing the clarity of the rules and the operability of the rules.By strengthening the balance between clear rules and operational design,it provides theoretical and practical guidance for the localization of sports dispute resolution mechanism in China.
