摘要:: 反兴奋剂处罚委员会是我国结合国内反兴奋剂工作实际和国际反兴奋剂规则要求设立的一项制度创新。在《体育法》修改后新的立法背景下，反兴奋剂处罚委员会的存废和发展路径存在一定的争议。通过逻辑分析、比较分析等方法，借鉴国际上有效的制度经验，提出反兴奋剂处罚委员会应将其职能定位于做出指控决定，为反兴奋剂中心收回处罚权奠定基础，同时减少中心的法律风险。为实现上述职能，应将处罚建议和审核权完全转交处罚委员会；明确处罚委员会中心内设独立委员会的性质；提升处罚委员会的专业性；健全完善处罚委员会工作机制；赋予中心就处罚委员会决定提出听证的权利；安排负责应对法律挑战的机构和人员。

Abstract:: The Anti-Doping Penalty Committee is an institutional innovation made by China in combination with the actual domestic anti-doping work and the requirements of international antidoping rules.In the context of the new legislation after the revision of the Sports Law,there is some controversy over the existence,abolition and development path of the Anti-Doping Punishment Committee.Through logical analysis,comparative analysis and other methods,and drawing on the experience of effective international systems,it is proposed that the functions of the Anti-Doping Punishment Committee should be positioned to make a decision on allegations,lay the foundation for the Center to recover the right to punish,and reduce the legal risks of the Center.In order to achieve the above functions,the punishment recommendation and review power should be fully transferred to the Punishment Committee,the nature of the independent committee within the Punishment Committee Center should be clarified,the professionalism of the Punishment Committee should be enhanced,the working mechanism of the Punishment Committee should be improved,the Center should be given the right to submit a hearing on the decision of the Punishment Committee,and the Center should arrange for institutions and personnel responsible for responding to legal challenges.
