论参赛权内涵扩张与遏制赛场畸形“饭圈”行为的法理逻辑及其制度实现-《体育科学研究》

摘要:: 赛场是体育竞技的核心场域，维护晴朗的竞赛环境意义重大，但既有规制难以应对畸形“饭圈”行为。为此提出建构新型参赛权的治理方案：法理上，突破传统参赛权的内涵局限，将其拓展为涵盖参赛资格准入与清朗竞赛环境的复合性权利，通过权利演进的类比、体系整合的优势及公平竞争规范回应质疑，并以运动员权利觉醒、请求权的跨域适用、法规体系的融贯证成正当性；制度上，明确体育行政部门、单项体育协会及赛事组织者多元义务，构建赛场特别救济机制与场外体育仲裁衔接的权利救济体系，系统性遏制畸形“饭圈”行为，实现赛场秩序的规整与运动员权益保障的目标同构。

Abstract:: As the core field of sports competition,the competition environment maintenance is of great significance,but the existing regulations are difficult to deal with abnormal fan circle behavior.For this reason,a new governance plan for the right to participate is proposed:in terms of legal theory,it breaks through the limitations of the connotation of the traditional right to participate,and expands it into a complex right covering the qualification access and clear competition environment.It responds to doubts through the analogy of rights evolution,system integration advantages and fair competition norms,and proves its legitimacy through the awakening of athletes’ rights,the cross-domain application of the right to request,and the integration of the legal system;in terms of system,it clarifies the multiple obligations of sports administrative departments,single-sport associations and event organizers,and constructs a rights relief system that connects special relief on the field with off-field sports arbitration,systematically curbs abnormal fan circle behavior,and achieves the isomorphism of the goals of regularizing the field and protecting the rights of athletes.
