摘要:
随着两岸民商事交往的增加，针对海事侵权纠纷的适用冲突及判决的承认与执行也随之增多。基于两岸在海事侵权相关规定上的差异，可能带来平行诉讼及适用规避等问题。两岸应建立完善有效的海事区际私法协助安排，协调两岸有关管辖权和规则适用方面的分歧，并形成相应的配套机制，这将有助于两岸经贸交流的制度成本节约和障碍消解。
Abstract:
Cross-strait economic exchanges have been increasing, so have the legal conflicts and the recognition and enforcement of cross-strait maritime tortious judgments. Because of the differences in maritime tort legislation between the two sides, parallel litigation and legal evasion are easy to be brought into practice. In order to reduce the institutional costs and to overcome the legal obstacles to the cross-strait economic and trade exchanges, the two sides should establish an effective maritime interregional private law assistance arrangement; coordinate their differences concerning jurisdiction and the application of laws, and set up corresponding supporting mechanisms.
