摘要:: 上海代孕龙凤胎案经过一审、二审，终于尘埃落定，但由此引发的争论却没有停止。对一审二审截然相反的判决结果人们有着不同的评判，特别是二审对女方监护权的确立，维护了“儿童利益最大化原则”，保障了未成年人的合法权益。但对此判决结果却又总是让人感觉如鲠在喉：我国法律明确禁止代孕行为，在此案中女方作为代孕行为一方的共谋者，在男方过世后却继受了原违法行为所带来的结果，这样的判决结果是否有违“任何人都不能从不当行为中获益”的法理原则，值得人们进一思索和探讨。法律是保障合法权利的，但对于因违法而获得的权利要保障时却必须慎之又慎。

Abstract:: After the first and second trials, Shanghai surrogate twins case was recently settled, but the controversy it caused has not stopped, people have a different evaluation on the two opposite verdicts, especially about the establishment of the woman’s custody by the second trial, maintaining the “the best interests of the child” principle, protecting the legitimate rights and interests of the minors. This decision seems like a choke in the throat: surrogacy is expressly prohibited by the law of our country. In this case, the woman acts as a conspiracy of surrogacy, but receives the merits from her unlawful act after the death of the man. Whether or not this result violates the legal principles of “no one can profit from the misconduct” is worth people thinking and discussing. The law is set to protect the legitimate rights, but we must be cautious when it comes to conserving the illegally gained rights.
