摘要:
著作权保护期是维系作者利益与社会公共利益之间“合理”平衡必须考虑的重要因素。纵观国际著作权法的制定与修正演变史，著作权保护期呈现不断延长的趋向。基于我国文化产业国际竞争力不断提升的背景，我国宜顺应国际立法趋向而修正著作权法。相对缓和的部分修正方案，应当被优先考虑，即修正著作权法，将视听作品、雇主作品等特殊作品的著作权保护期从50年延长至70年。
Abstract:
The term of copyright is an important factor which should be considered in the “rational” balance between the author’s interest and social public interest. The legislation and revision history of international copyright laws have revealed a tendency to extend the term of copyright. Based on the background of the increasing international competitiveness of China’s cultural industry, we should follow the tendency and revise our copyright act. A legislative amendment plan, which isn’t too radical，should be given priority. The plan is to extend the term of some special copyrights from 50 years to 70 years, such as the copyright of audiovisual works and employer’s works.
