摘要:: 儿童“最大利益原则” 得到国际统一认可，在涉及未成年人犯罪时，采取最大化原则保护他们的合法权益。这项政策出自《儿童权利公约》，我国刑法关于刑事责任年龄的规定充分体现这一原则，但近年来发生多起未成年人犯罪案件，引发人们广泛关注，必须平衡未成年人保护与责任承担问题。对未成年人犯罪宜采用“定性”分析法，对未达到刑事责任年龄的行为人行为的违法性予以否定性评价；疏通未成年人犯罪后进入工读学校及改造良好的少年及时回归正规学校的路径；对于必须接受刑罚惩罚的未成年人应做好证据封存；对涉刑事案件的未成年人审判应通知合适成年人到场；认真执行附条件不起诉等相关措施，切实保障未成年人的健康成长。

Abstract:: The principle of “maximizing the interests of children” has been universally recognized,and when it comes to crimes committed by minors,the principle of maximizing the protection of their legitimate rights and interests is adopted.This policy is derived from “The Convention on the Rights of the Children”,and the provisions of our criminal law on the age of criminal responsibility fully reflect this principle.However,in recent years,there have been many cases of juvenile delinquency,which have aroused widespread concern.It is necessary to balance the protection of minors with the issue of responsibility.It is advisable to use the “qualitative” analysis method to analyze the illegality of the behavior of the perpetrators who do not reach the age of criminal responsibility.Dredge the way for minors to enter the reform school after committing crimes and have the well-reformed teenagers to return to the regular school in a timely manner;For minors who must be punished,evidence should be sealed;The trial of a minor in a criminal case shall be notified to the appropriate adult;We will earnestly implement relevant measures such as not prosecuting minors with conditions attached,and ensure the healthy growth of minors.
