摘要:: 《知识产权强国建设纲要（2021-2035年）》提到非物质文化遗产转化利用，21世纪海上丝绸之路非遗建设与之契合，而海洋非遗转化利用亟需相应司法执法的体系化保障。以海洋非遗大省福建为例，应当直面海洋非遗分类、主体认定难等相关司法执法问题，检视海外与产业融合的保障激励制度，依法实施对再创新权益认定的司法保护和转化利用权益分享的执法保障，以体系化的整体保护理念推进海洋非遗转化利用的“海洋非遗+数字文旅”深度融合。其中，对本土海洋非遗技艺转化利用载体的私权利保护是司法执法建设的关键。〖JP〗

Abstract:: The Plan on the Development of Intellectual Property Rights Power (2021-2035) mentions the transformation and utilization of intangible cultural heritage,which is in line with the construction of intangible cultural heritage on the 21st Century Maritime Silk Road.The transformation and utilization of marine intangible cultural heritage urgently needs the systematic guarantee of corresponding judicial enforcement.Take Fujian as an example,which is famous for its marine intangible cultural heritage.It shall face the relevant justice and law enforcement issues such as the classification of marine intangible cultural heritages and the difficulty in identifying the main body.On the basis of reviewing the guarantee and incentive systems of overseas industrial integration,it shall implement the judicial protection for the recognition of re-innovation rights and interests protection for the sharing of transformation and utilization rights according to law.It shall promote the deep integration of “marine intangible cultural heritage + digital cultural tourism” for the transformation and utilization of marine intangible cultural heritage with a systematic and overall protection concept.Among the above,private rights protection of the carrier for the transformation and utilization of local marine intangible cultural heritage is the key to the construction of justice and law enforcement.
