数字时代女性平台从业者劳动权益困境及数字治理路径——基于福州市家政平台的田野观察-《集美大学学报》（哲社版）

摘要:: 数字时代催生出零工经济、零工劳动者等新就业模式与新就业形态，零工平台成为女性重要的就业载体，女性平台从业者具有“女性”与“平台”的双重身份特性。通过对福州市零工平台的田野观察，分析女性平台从业者劳动报酬、休息休假、职业技能培训等权益，以及就业过程中劳动权益保障的性别失语，探讨数字平台场域裹挟下女性平台从业者劳动权益困境的生成逻辑，从非标劳动关系规制缺位、维权能力和支配资源匮乏、平台权责与监管失衡、公共平台生态位缺失、零工经济的性别化排斥等寻求可能的影响因素，并从劳动关系认定标准、劳动权益保障、女性公共参与意识、建构职业伤害保障试点、特殊的性别劳动保护等维度探索数字治理的有效路径，从而优化零工平台的女性权益保障，促进经济的高质量发展。

Abstract:: The digital era has fostered new employment models and forms,notably the gig economy and gig work.Gig platforms have become significant employment channels for women,endowing female platform workers with a dual identity characterized by both femininity and platform affiliation.Through ethnographic observation of domestic service platforms in Fuzhou,this study analyzes the labor rights of female platform workers concerning remuneration,rest and leave,and vocational skills training.It examines the phenomenon of “gendered silence” in labor rights protection during their employment and explores the underlying logic behind the labor rights dilemmas they face within the digital platform ecosystem.
