摘要:: 低空经济的高质量发展需有法治保驾护航。目前，中国已出台关于低空经济的地方性政策，建立起以《民用航空法》为核心、以《无人驾驶航空器飞行管理暂行条例》为代表的法规和规范性文件组成的法治体系。低空经济的发展在技术研发、知识产权保护、飞行安全、隐私权保护、空域管理、适航认证、争议解决、责任追究、保险制度和国际合作等方面仍面临风险挑战。中国应完善顶层设计，通过低空经济专项立法，循序渐进地针对无人机、电动垂直起降飞行器、直升机开展研发，针对空域管理、知识产权保护等具体问题制定规则或办法，细化现有规定，弥补立法空白，在全球或区域范围内制定统一的国际规则，推动低空经济在法治轨道上高质量发展。

Abstract:: The high-quality development of the low altitude economy requires the protection of the rule of law.At present,China has introduced local policies on low altitude economy and established a legal system consisting of regulations and normative documents represented by The Civil Aviation Lawand The Interim Regulations on the Management of Unmanned Aerial Vehicle Flights.However,the development of low altitude economy still faces practical risks in technology research and development,intellectual property protection,flight safety,privacy protection,airspace management,airworthiness certification,dispute resolution,accountability,insurance system,and international cooperation.In the future,China should develop a comprehensive top-level design,gradually formulate rules or measures for the development of drones,electric vertical takeoff and landing aircraft,helicopters,or specific issues such as airspace management and intellectual property protection through special legislation on low altitude economy,refine existing regulations,fill legislative gaps,formulate unified international rules at the global or regional level,and promote high-quality development of the low altitude economy on the track of the rule of law.
