摘要:
高校在办学过程中，为维护校园秩序，保证教育公平，难免会对违规违纪学生进行纪律处分。然而，对学生进行纪律处分后是否将相关的信息进行公开、如何公开以及在多大范围内公开，相关教育法规并没有进行明确规定，各个高校也没有形成共识，做法也形式多样。从信息公开的内在要求和纪律处分的教育本质的视角进行分析，高校有必要对纪律处分的信息进行公开，这种公开必须是适度公开，需要充分保护受处分学生的个人隐私；处分信息的适度公开要注意公平公正原则和人本原则；为保障纪律处分信息公开的程序正义和实体正义，需切实规范公开的程序、公开的内容和公开的范围。
Abstract:
In order to maintain the campus order and ensure education equality, it is inevitable that university will punish the students based on relevant regulations. However, the relevant education laws and regulations did not make it clear whether the relevant information of disciplinary action will be disclosed and how to be disclosed. From the perspective of the inherent requirement of information disclosure and the essence of punishment, it is necessary to disclose the information of disciplinary action and information disclosure must be appropriate in order to fully protect the students’ personal privacy. The principle of fairness and justice and the principle of humanism need to be used in particular. Meanwhile, the information disclosure procedure, the content and the scope need to be standardized in order to protect the procedural justice and substantive justice.
