摘要:: 体育赛事转播权是体育产业中最具经济价值的一个组成部分，在网络时代下催生出了盗播侵权行为。体育赛事转播权的保护在我国现行著作权法及相关法律体系下无法找寻恰当的法律依据，也不存在与之相关的国际条约规定，致使在实践中常常出现同案不同判的现象。因此，我国有必要借鉴外国法中关于体育赛事转播权的具体规定，以及国际条约中的立法精神，建构并保障体育赛事转播权这一新兴权利。最后，结合体育赛事转播权的法律性质，来分析体育赛事转播权在我国现行法律体系下的两种容纳途径。

Abstract:: Sports event broadcasting rights are one of the most economically valuable components of the sports industry,while in the Internet era,piracy and infringement are frequent.Under the current copyright law and related legal system in China,there is no proper legal basis for the protection of sports event broadcasting rights and there is no relevant international treaty,which leads to the confusion of different judgments of the same case in practice.Therefore,it is necessary for China to use the specific provisions on sports event broadcasting rights in foreign laws as reference,and the legislative spirit in international treaties to construct the emerging rights of sports event broadcasting rights.Finally,combining with the legal nature of sports event broadcasting rights,this paper analyzes the two ways to accommodate sports event broadcasting rights under the current legal system in China.
