摘要:: 在社会法特别诉讼中，举证责任的分配影响案件裁判结果的公正性，关系到社会成员权益的维护及社会法立法目的的实现。我国目前尚未建立社会法诉讼特别程序，在社会法纠纷解决时主要适用传统民事诉讼和行政诉讼举证责任分配规则，这与社会权救济存在冲突，影响救济效果。基于社会法纠纷的性质，社会法特别诉讼举证责任的分配应以倾斜保护弱势群体、公正与效率并重为价值原则，通过一般规则、举证责任专属与自由裁量相结合的方式进行合理设计，以妥善解决社会法纠纷，实现社会公平正义。

Abstract:: In the special litigation of social law, the distribution of the burden of proof affects the justice of the judgment result of the case, and is related to the maintenance of social members’ rights and interests and the realization of the legislative purpose of social law. At present, the special procedure of social law has not been established in our country, and the distribution rules of the burden of proof are mainly applied in traditional civil and administrative litigation, which conflicts with the relief of social rights and affects the relief effect. Based on the nature of social law disputes, the distribution of burden of proof in special litigation of social law should be based on the value principles of slanting protection, fairness and efficiency, and through the combination of general rules, inversion of burden of proof and discretion, so as to properly solve social law disputes and realize social fairness and justice.
