摘要:
政府购买公共体育服务是转变政府职能、建设服务型政府的重大举措。采用文献资料法等方法，分析政府购买公共体育服务的行政法理论基础，探讨我国政府购买公共体育服务领域的法律问题。研究认为，我国政府购买公共体育服务的法律问题包括：立法结构缺陷和内容缺失、主体之间不平等、法律程序不规范、监督机制乏力等。针对上述问题，提出了构建以《政府购买公共服务法》为核心，多位阶联动的法律体系，创建合同订立与履行的新模式，健全民意先导、公正公开的法律程序，建设内外联合、贯穿全程的监督体系等方案。
Abstract:
The government purchase public sports service is a major move to transform government functions and build a service-oriented government.The article mainly adopted literature method to analyzes the theoretical basis of government’s purchase of public sports service，and the legal problems of our government in the field of public sports service.The research holds that the legal problems of the public sports service of our government include the following aspects：the structural flaws and lack of content in legislation，the inequality among the subjects，the nonstandard procedure of the law，the lack of supervision mechanism and so on.In view of the above problems，the following measures are proposed in this study：Constructing the legal system of multilevel linkage with the core of “Government Purchase Public Service Law”；Create a new model for contract formation and performance；Perfecting the legal procedure of the public opinion Departure from the principle of fair and open；Construction supervision system of internal and external linkage and throughout the whole course.
